The seven-day home exchange exemption versus a 30-day rent restriction;this inconsistency in applying rental duration restrictions is most curious. Whether classified a ‘tenant’ or a home exchange “guest” – the occupants are not necessarily previously known to the owner and, in fact, fall within the same parameters. When DMMA board members have been queried about this discrepancy, responses have varied from “the home exchange Site vets more rigorously than owner directed listing Sites” to “many of us have had experience with home exchanges”.
How is a 7-day exchange any different from a 7 day rental? Is an exchange paid in kind fundamentally different from an exchange paid in dollars? Doesn’t allowing 7-day exchanges create a an easy way to skirt the restriction on rentals of less than 30 days? There’s no practical way to distinguish someone exchanging at Desert Mountain from someone renting at Desert Mountain.
In addition, many owners have expressed a concern that this kind of inconsistency of restrictions could lead to litigation, something that our community as a whole should not have to shoulder.
