Villages and Rental Restrictions

There are 27 Villages in Desert Mountain all with registered Village CC&Rs. 6 Villages have a minimum rental period of 30 days and they are:

Cochise Geronimo
Lone Mountain II
Lost Star
Saguaro Forest
Seven Arrows
Haciendas

The first 5 Villages listed contain the following provision:

An Owner who leases or otherwise grants occupancy rights to his Lot to any Person shall be responsible for assuring compliance by the Occupant with all of the provisions of the Village Declaration, the Articles, Bylaws, Association Rules and Design Guidelines and shall be jointly and severally responsible for any violations by the Occupant thereof. If, by separate membership agreement, an Owner has acquired the right to use all or any portion of the Golf Club Facilities or Private Facilities, the Owner may not, by virtue of leasing the Owner’s Lot, confer upon the lessee any use privileges with respect to the Golf Club Facilities or Private Facilities. Such privileges, if any, are available only pursuant to the rules, policies and procedures of the club governing bona fide accompanied guests of club members.

To retain the ambiance and character appropriate to a custom lot subdivision (i.e., comprised of custom built, single-family homes on Lots with building envelopes), the minimum rental period allowed for a lease or other occupancy agreement for any such portions of the Property shall be 30 days.

These 5 Villages are the only Villages in Desert Mountain in which the entire population of homes are 100% custom homes.

The Haciendas, not an original Desert Mountain Village, also maintains a 30-day minimum stay within their CC&Rs in order to “preserve the ambiance and character appropriate to the property.” The Haciendas is not a custom lot subdivision.

The remaining 21 Villages within Desert Mountain are made up of either completely semi-custom homes, cottages, or a mix of semi-custom and custom homes. None of the remaining 21 are comprised of 100% custom homes.

These remaining 21 Villages, as a result, have no minimal rental restrictions in effect. It was intended by the developer that the remaining Villages would be likely owned by individuals who would be most likely to live in Desert Mountain part time or visit from time to time. As a result, provisions addressing minimum stay requirements have never been in effect in relation to rentals as it was expected homes in these 21 Villages would serve to address the rental needs of the community.

Many homeowners, including some serving as Village representation, feel strongly that if the restriction has historically resided with the Village, it ought to remain within the Village as the precedent has been long established.
